These terms cover your use of the NOD iPhone app, the NOD companion for X-Plane on Mac, and this website (together, “NOD”). NOD is a product of Design By, operated by Otium Creations (Pty) Ltd, a company registered in South Africa under registration number 2025/557746/07. In these terms, “we”, “us” and “our” mean Otium Creations (Pty) Ltd. By using NOD you agree to what follows.
Licence
NOD is licensed to you, not sold. You may use it for your own personal flight simulation on devices you own or control. The licence is personal and non-transferable. Your use of the iPhone app is also subject to Apple’s standard App Store terms.
You may not sell, rent, sub-licence or redistribute NOD, and you may not reverse engineer, decompile or modify it, except to the extent that law expressly permits despite this restriction.
Free allowance
NOD includes ten minutes of successful simulator tracking at no cost, so you can confirm it works on your own equipment before deciding to buy. The allowance is measured only while tracking is genuinely working — connected to X-Plane, with your face tracked and a neutral set. Time spent searching for your Mac, paused, or with the app in the background does not count. The allowance is a single lifetime allowance per installation, not a per-session or per-day one.
NOD Core
- NOD Core is a one-time purchase that removes the time limit. There is no subscription and no recurring charge.
- The purchase is made inside the iPhone app and is handled by Apple. The price shown is the one Apple sets for your region.
- NOD Core is tied to your Apple Account. Use Restore Purchases in the app to unlock it again after reinstalling or on another device signed in to the same Apple Account.
- NOD unlocks only when Apple confirms the purchase. If Apple reports a purchase as refunded or revoked, the unlock ends.
- Payments, receipts and refunds are administered by Apple under Apple’s terms. We never receive your card or payment details. We do not process payments and cannot issue refunds ourselves; refund requests go to Apple, and any statutory refund rights you have are unaffected.
What NOD requires
NOD is supported on the combination we have verified end to end:
- X-Plane 12 on a Mac, with the NOD companion installed;
- an iPhone that supports face tracking, with camera and local-network permission granted;
- both devices on the same local network.
NOD is not supported on other simulators, other platforms or other configurations. Supplying that environment, including a working network, is your responsibility.
Availability and compatibility
NOD is software that sits between your iPhone and a simulator we do not control. Updates to iOS, macOS or X-Plane may affect how NOD behaves, and NOD may need its own update in response. We do not promise that NOD will be uninterrupted, error-free, or permanently compatible with future versions of software published by others. This website and any downloads may be unavailable from time to time.
Responsible use
NOD is for flight simulation and entertainment. It is not an aviation instrument, not a training device, and must not be relied on for real flight, navigation or any safety-related purpose. Do not use NOD while operating a vehicle or aircraft.
Intellectual property
NOD, the NOD name, the NOD mascot, its artwork and its software remain the property of Otium Creations (Pty) Ltd. Nothing here transfers ownership. X-Plane is a trademark of Laminar Research; Apple, iPhone, Mac and App Store are trademarks of Apple Inc. NOD is an independent product and is not affiliated with, endorsed by or sponsored by Laminar Research or Apple.
Liability
NOD is provided as it is. To the fullest extent the law allows, we are not liable for indirect or consequential loss, lost data, lost time, or loss arising from NOD being unavailable or incompatible. Nothing in these terms limits liability that cannot legally be limited, and nothing here affects consumer rights you have by law, which vary by country and which these terms do not replace.
Governing law
These Terms are governed by the laws of the Republic of South Africa, subject to any mandatory consumer-protection rights that apply to you where you live. Nothing here removes or limits rights you have under the Consumer Protection Act 68 of 2008 or under the consumer law of your own country.
Ending the licence
You may stop using NOD at any time by deleting it. The licence ends if you breach these terms. We may change NOD, or these terms, as the product develops; material changes will be published here with a new date at the top, and continuing to use NOD after that means you accept them.
